Terms of Service
Effective date: September 17, 2026
These Terms describe the use of the MDX Tech Solutions (“MDX,” “we,” “us”) website and the general conditions for requesting our remote and digital technology services. Please review them before submitting a request or purchasing services. A purchase or engagement requires the applicable agreement and authorization; browsing this website alone does not authorize paid work.
1. Services and eligibility
MDX offers website and web solutions, AI and workflow automation, business technology consulting, remote technical support, and digital presence and branding services. We do not provide onsite services, physical hardware installation, structured cabling, electrical work, or physical network infrastructure installation through this website.
You must be at least 18 and legally able to enter an agreement to purchase services. If acting for a business or organization, you must have authority to authorize the requested work and bind that organization.
2. Requests, proposals, and project scope
Submitting a form, selecting services, or requesting information does not create an obligation to purchase additional work and does not require MDX to accept a project. A consultation is an initial discussion and assessment; it does not include implementation, development, ongoing support, or a finished deliverable unless separately agreed in writing.
Project scope, deliverables, pricing, payment schedule, revisions, timelines, access requirements, ownership, and any recurring services must be set out in the applicable proposal, statement of work, or service agreement. Published package descriptions are subject to the stated scope and written confirmation. Third-party subscriptions, domains, hosting, licenses, and similar costs are separate unless expressly included.
3. Consultation fee, booking, and cancellation
The consultation fee is $30.00 USD and is non-refundable, subject to the MDX cancellation exception in the Consultation Agreement and any rights that cannot be excluded by law. The consultation agreement must be affirmatively accepted before proceeding through the website booking flow.
Submitting intake information does not reserve an appointment or constitute payment. The booking process uses Google Calendar and Stripe; complete the scheduling and payment steps and retain your booking confirmation. The fee covers the consultation only and is not automatically credited toward later services.
You may request rescheduling by contacting MDX at least 24 hours before the appointment, subject to availability. Client cancellation or failure to attend does not entitle the client to a refund. If MDX cancels and cannot provide the consultation or a reasonable rescheduling opportunity, the cancellation exception in the Consultation Agreement applies.
For the consultation, the specific Consultation Agreement controls if it conflicts with these general Terms. These Terms do not expand or remove the refund exception in that agreement.
4. Other payments and refunds
For services beyond the consultation, fees, deposits, milestones, renewals, cancellation, and refund conditions are governed by the applicable written service agreement and disclosures made before purchase. The consultation’s non-refundable fee does not automatically make every other MDX payment non-refundable. We will not begin additional paid work or recurring charges without the applicable authorization.
Payments are processed by third-party providers. You must use an authorized payment method and provide accurate billing information. If you believe a charge is incorrect, contact us promptly so we can investigate. Nothing here restricts payment-dispute or other rights provided by applicable law.
5. Client responsibilities and authorized access
Provide accurate information, timely feedback, and materials you have permission to use. You are responsible for maintaining appropriate backups before changes are made to your systems. Only authorize access to systems, accounts, and data you are entitled to control. Any remote access or changes require a separately agreed scope and appropriate authorization.
Do not send passwords or sensitive credentials through the public intake form or ordinary email. Do not use the website or our services for unlawful activity, infringement, malicious code, unauthorized access, harassment, or interference with another person’s systems.
6. Intellectual property
MDX and its licensors retain rights in existing website content, branding, materials, tools, and methods. Clients retain their rights in materials they supply. Rights in paid project deliverables, and any related licenses or transfer conditions, are determined by the applicable project agreement. Purchasing a consultation does not transfer ownership of MDX intellectual property or third-party software.
7. Third-party tools and service limitations
Google, Stripe, hosting providers, software vendors, social networks, and other third-party services operate under their own terms and policies. Their availability, features, pricing, and actions are outside MDX’s control. We do not guarantee uninterrupted website access or a particular business, revenue, search-ranking, security, or other outcome.
Recommendations depend on the information available and the capabilities of relevant systems. An initial consultation is not a formal security, legal, accessibility, or regulatory audit. MDX provides technology services, not legal, accounting, tax, investment, or other regulated professional advice.
8. Privacy and communications
Our Privacy Policy explains how we handle personal information. We may communicate about your request or authorized services using the contact information you provide. Submitting an inquiry does not subscribe you to a marketing mailing list. Do not record a consultation without providing notice and obtaining any consent required by law.
9. Liability and mandatory rights
Any consultation-specific liability limitations are set out in the Consultation Agreement. Liability provisions for project work are governed by the applicable service agreement and law. Nothing in these Terms excludes liability that cannot lawfully be excluded or removes mandatory consumer rights or remedies.
10. Changes, suspension, and governing law
We may update website content and these Terms. Updates will show a revised effective date and apply prospectively; they do not retroactively change an existing signed or accepted service agreement without the agreement or notice required by its terms and applicable law. We may restrict website access reasonably necessary to address misuse, security incidents, or legal requirements.
These Terms are governed by South Carolina law, except where applicable law requires otherwise. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Contact us first about a concern so we can attempt to resolve it; doing so is not a waiver of your legal rights.
